Dear Honourable Minister Melanie Joly, Dear Honourable Minister Marco E.L. Mendicino. In 2012, on the recommendation of the Minister of Foreign Affairs, in consultation with the Minister of Public Safety and Emergency Preparedness of Canada, His Excellency, the Governor in Council, made the order establishing a list of foreign state supporters of terrorism. The list included two countries: Islamic Republic of Iran and Syrian Arab Republic. According to the State Immunity Act, Section 6.1(2) “The Governor in Council may, by order, establish a list on which the Governor in Council may, at any time, set out the name of a foreign state if, on the recommendation of the Minister of Foreign Affairs made after consulting with the Minister of Public Safety and Emergency Preparedness, the Governor in Council is satisfied that there are reasonable grounds to believe that the foreign state supported or supports terrorism.” By being placed on this list, states lose their immunity from the jurisdiction of Canadian courts in relation to civil suits brought against them in connection with their support of terrorism. The countries were placed on the list for a number of reasons, such as: supporting terrorist violence in the neighbouring states; possessing conventional and chemical weapons that could end up in the hands of terrorist groups; providing arms and training terrorist groups. For years now the Russian Federation has been supporting and arming separatist militia (which resulted in thousands of casualties, including shooting down a civilian MH17 flight); collaborated with regimes, identified in Canada as state supporters of terrorism. For the past five months, the Russian Federation has been continuiusly bombing civilian targets in most cities of Ukraine - a neighbouring sovereign country, Canada’s ally. Hundreds of children have been killed. For political and expansive reasons. Moreover, the Russian Federation has been blackmailing countries that are dependent on Russia’s natural gas supplies. In Canada, section 83.01 of the Criminal Code defines terrorism as an act committed "in whole or in part for a political, religious or ideological purpose, objective or cause" with the intention of intimidating the public "…with regard to its security, including its economic security, or compelling a person, a government or a domestic or an international organization to do or to refrain from doing any act." If what the Russian Federation does, is not enough to declare the Russian Federation a state supporter of terrorism (or better yet a terrorist entity), I do not know what is. It is time for Canada to do the right thing and add the Russian Federation to the list of state supporters of terrorism.
